I. Generalities and Acceptance:
These Terms and Conditions (hereinafter, the “Terms”) govern the acquisition of and access to the BizData Book 2025-2026 (hereinafter, the “Publication”), produced by the Puerto Rico Chamber of Commerce (hereinafter, the “Chamber”).
By acquiring the Publication, whether in printed, digital, or combined format, the purchaser (hereinafter, the “Client”) acknowledges having read, understood, and accepted these Terms. Performing any of the following actions shall constitute evidence of said acceptance:
(a) completing the purchase process;
(b) making the corresponding payment; or
(c) accessing or using the digital content of the Publication, as applicable.
These Terms constitute a valid and binding agreement between the Client and the Chamber, to the extent permitted by applicable laws.
If the Client does not agree with these Terms, they must refrain from completing the purchase or accessing the Publication.
II. Nature of the Product:
BizData Book 2025-2026 is an editorial publication of an informative, analytical, and statistical nature. Its content is offered “as is” and is provided solely for informational purposes.
It will be available, as applicable, in the following formats: (a) printed format; (b) digital format; or (c) combined format.
Its content does not constitute, nor should it be interpreted, as legal, financial, tax, or investment advice.
The Chamber does not guarantee specific results derived from the access, use, or interpretation of the Publication’s content.
III. Price:
The price of the BizData Book 2025-2026 corresponds exclusively to the value of the Publication in the format selected by the Client.
Said price does not include shipping, handling, or any other additional charges, unless expressly stated otherwise at the time of purchase.
Shipping costs, if applicable, will be disclosed to the Client and invoiced separately.
IV. Payment:
Payment must be made through the methods enabled by the Chamber.
Confirmation of payment shall constitute a mandatory requirement to process the shipment of the printed copy or to enable access to the digital content of the Publication.
If the payment is not validated, approved, and completed on the corresponding platform, the Chamber reserves the right to cancel or reject the transaction, as appropriate.
V. Delivery:
Delivery dates for the Publication in printed format are estimates and may vary due to production, logistics, availability, or force majeure events.
In the event that the carrier company makes three (3) unsuccessful delivery attempts, the shipment will be returned to the warehouse. No refunds will be issued, and any reshipment of the printed Publication will require prior payment of the total shipping cost, which must be covered by the Client before a new dispatch is processed.
The Chamber shall not be liable for delays, returns, additional costs, or impossibility of delivery attributable to third parties, carrier companies, incorrect shipping information, absence of the recipient, or other circumstances beyond its reasonable control.
VI. Access:
Access to the Publication in digital format, where applicable, shall be granted via link, credentials, or through the platform designated by the Chamber.
Access to the digital content will be granted for a period of three hundred and sixty-five (365) days counting from the date said access is enabled. Once said period has elapsed, access will expire automatically.
The Chamber will maintain the availability of access to the digital content during the corresponding period. However, it shall not be responsible for temporary interruptions, delays, or access limitations attributable to third parties, service providers, software, technological platforms, systems, digital infrastructures, or any other circumstance.
VII. Cancellation and Refund Policy:
All sales are final.
Consequently, cancellations, returns, or requests for refunds will not be accepted once the purchase is confirmed or, as applicable, access to the digital content of the Publication has been enabled.
VIII. Intellectual Property and Permitted Use:
All content of the BizData Book 2025-2026 is protected by applicable copyright and intellectual property laws.
The acquisition of the Publication grants the Client a limited, non-exclusive, non-transferable, and revocable license for the personal or internal institutional use of the content, in accordance with these Terms.
The reproduction, distribution, assignment, sale, modification, or any commercial use of the content of the Publication, in whole or in part, is prohibited without the prior written authorization of the Chamber.
Access to the Publication in digital format is granted exclusively for consultation and visual use in accordance with these Terms. Said access does not confer upon the Client any right to download, copy, locally store, reproduce, or redistribute the content of the Publication, in whole or in part, by any means.
The Chamber may implement reasonable technical and operational measures to control access and protect the integrity and confidentiality of the digital content.
IX. Limitation of Liability:
The liability of the Chamber, if any, shall be limited in all cases to the amount paid by the Client.
In no event shall the Chamber be liable for indirect, incidental, special, consequential, or any other damages arising from the access, use, or interpretation of the content of the Publication.
X. Modifications:
The Chamber reserves the right to update or modify these Terms at any time. The applicable Terms shall be those in force and published at the time the Client makes the printed or digital purchase.
XI. Applicable Law and Jurisdiction:
These Terms shall be governed by and interpreted in accordance with the laws of the Commonwealth of Puerto Rico. Any controversy related to these Terms shall be submitted to the state or federal courts with competent jurisdiction in Puerto Rico.
